If you listen to the hearing, you’ll hear eight of the justices unravel every stance that the Kolorado Klan takes. Kavanaugh asked for a definition of insurrection and who was eligible to decide someone was guilty. They questioned the chaos of finding in Kolorado’s favor, having other states remove other names, those cases being challenged, and winding up having to take fifty cases to the Supreme Court every election. Jackson Brown blew him up on why they didn’t just say the restriction applied to the president if that’s what they meant. Mostly it seemed, they weren’t swallowing that it was self executing and didn’t require conviction at trial, or that states had any role in enforcing Section 3. They made it clear that given the restriction’s ability to be removed by Congress, it was unlike the age and natural born qualifications for president. They kicked the smell out of this case.

Crenshaw is not a senator and his vision is somewhat obstructed. He, and Lankford for that matter, don’t rate highly among conservatives. He sounds like the typical “we have to do something, even if it’s wrong” type that we don’t want to follow. There were no new laws passed between the time Trump was in office and now. The difference is Biden. I’d bet ten dollars to a donut hole that if Biden put Trump in control of the border right now, he’d shut it down. Because he wants it shut down. That’s the difference.

Maybe they’ll draft Amy Klobuchar to run again.

You’ve yet to learn that labeling people can be unreliable? Originalism has been practiced since the document was written, and overlaps with textualism. I’ve made none of the arguments you’ve expressed, and the Constitution has required zero amendments to deal with the Industrial Revolution because it addresses the policy of limited government and liberty, not tools. Modern ideology is the concept that describes it as a living document or a relic. In their wisdom, the authors, original and subsequent, strove to relay the concept without exacting limitations.

I disagree with the qualifications of Republican, and they certainly were not originalist.
