  3. This is a good example of how most people understand this preposterous ruling. If each state followed suit it would be chaotic. How supposedly intelligent people can study law, and be considered good enough to make it to the bench, only to churn out this kind of partisan garbage is what destroys the people’s confidence in the institutions of our civilization.

  6. Maybe. Maybe it indicates how difficult it is to get a straight deal.
  7. This case has more holes than a Swiss cheese. Is it any indication that of eight dimocrat judges involved, the vote is split 4-4? Maybe 4.5-3.5.
  8. No. It gives Congress the power to write a statute that would be enforced by the executive and judicial branches. The court is not given the power to act independent a conviction of the statute.
  9. A textualist would read that as: Congress (not the court) shall have the power (unless so legislated by Congress)
  10. I don’t understand your question. You may not realize that the sentence is Section 5 of the 14th Amendment to the Constitution.
  11. That is the 14th Amendment. Section 5 to be specific. What textualist would only read three fifths of an Amendment to guide his decision?
  12. Read on down to section 5 and you see: The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article. Which they did by writing statute that covers prosecutions and convictions of insurrection. Dimocrats don’t allow democracy within their party, there’ll be no dimocrat primary election for president. Will they be stopped before they destroy the country, because they certainly will be afterwards. Maybe by China. Maybe by Persia.

  20. Declaring sanctuary is more unconstitutional than state sanctioned border control, to my mind.
  21. It is a tough one. He is a coward, but even worse, I believe he knew he was a coward and by taking the job he prevented someone who wasn’t from filling the position. While it may not be actionable for him declining to react to the shots, if he is found to be derelict in preventing the shooter from entering the school, that may be.
